Can a co. use (and create revenue from) a registered url that contains a word/words that are trademarked?
workgroup is a trademark'd term and their website workgroup.com is used to sell software. Url workgroups.com is purchased by a diff co. to make $ from ad's via a social networking.

The trademark owner would have to notify them that they are in violation of trademark. If they do not respond, an attorney would need to send a letter asking them to stop using the trademark or face legal action. If they do not respond to that, then legal action would need to be pursued.
It's all a matter of how much you want to pay. The other site will most likely claim that they are using a generic term and the legal bills will begin climb. It then becomes a matter of who has the deeper pockets. |
