Can anyone post your photo on Facebook without your consent?
A friend of mine had her 'photo taken without her knowledge, and posted on Facebook along with defamatory remarks. It's in a group site which only members can see. Is this legal, and would Facebook regard it as abuse? We see blurred out faces on TV programs etc, when people don't want to be identified, which makes me wonder.
Thanks Sewrobb - the remarks accused her of doing something illegal and attack her character. It is part of a campaign and she is not the only one targetted.

yep, you can report them but to be honest there are loads of fake accounts on facebook.

If it's a hate site, then your friend can report the site to Facebook. This could be considered bullying.

As for legalities, for TV, you need to give permission since anyone can see the images, however, on Facebook, it's different, especially since it's a "members only" site. I'm guessing that this picture was taken in a public area, so that is not illegal, neither is the posting.

Unfortunately NO, there is nothing she can do about the photo.

The Copyright to belongs to the person who took it and they are able to
publish it or redistribute it where ever and whenever they like.

That was proved in a Stated Case in a Court of Law several years ago.

The decision was the Taker not the Subject who owns the copyright

No different to any Celebs who get caught off guard at an inappropriate
moment and it is plastered right across the World Press.

Also it all depends on what you call defamatory remarks.

You can only contact FB on that one to make a decision but they will
not remove the photo.
