Is a threatening post on Facebook be eligible for probation?
I posted some threatening posts on Facebook but it was unnamed, it was just like a conversation with a friend. But someone thought it was him/her that I was referring to so he filed a case. I was just wondering how long will be the jail time and will I be granted probation for this? We don't have laws against cyber crime in our country but it might be considered a classic case of grave threat. My only reason for posting is to ridicule but not to constitute harm. I am confused. Please answer this for me.

Not sure what kind of a case the person filed, but this does not sound like a serious situation. If you end up in court, you should get a public defender and you'll probably be fine, just tell them the truth, they are under confidentiality laws. I'm pretty sure the worst possible scenario is you'd have to take a one time 1 hour class on something stupid, maybe a few hours of community service, still that seems very unlikely.

There are multitudes of things to consider :
- What you meant as a ridicule, can be perceived as a threat by other people. Have you considered this? - You are correct that the cyber law may not apply, but the classic "grave threat" can still be applied on online platforms, including social networks. The best option for now, because he/she has filed a case is to contact someone who is well-versed in law to give you your options. Because law differs from one country to another, and since you don't specify your country, you must seek help from your local lawyers. |
