Can one be punished by law if one uses other's photo on their Facebook profile?
I know it's an odd question, but couldn't help the curiosity. As asked above, can one be punished by law if one uses someone else's photo as their profile picture on Facebook? And for this hypothetical question, assume it's no public figure or any celebrity, but just a commoner. However, while the person uses it as the profile picture, he/she nowhere claims that that's their own picture.

It's still Identity theft and fraud. You would need the persons permission to use their photo since Facebook is a public domain. To answer your question yes you could be punished by law. You could even face felony charges. But if you are asking what the chances are of you facing them it depends on what you are doing. But no matter what you are doing there is a chance you could be charged.
