Potentially yes. Unless it is a parody, it could fall under various fraud and/or misrepresentation theories

Of course there are civil law remedies as well.

Generally yes if you can track down the logs of the servers involved, and trace the ip addresses listed there back to a place and time and then a person. Same way it works for illegal downloads.
