I think it was a date rape because you were intoxicated and you did say I can't do this but at the same time you had sex again with him later. I'm not sure you could win that case because they would use that you had sex a second time against you. Please be so careful when you go to parties and drink. Maybe you can have a designated friend come along and keep an eye on you when you are intoxicated and also drive you home. I'm a mom of a teenage girl myself and I worry about things like that happening to her. I'm sorry that boy took advantage of you like that and I hope this doesnt affect your future relationships or you. You will be in my thoughts and Prayers!

Techinically, it is rape.... you could file a report but idk if you would want to considering you did have sex with him later that night. But its all up to you... it was rape but i guess if your okay with it then dont worry about it

Yes in the eyes of the law he sexually assaulted you on a couple of grounds.

You said you cant and you were under the influence of alcohol.
Although in respect to alcohol he could say the same about you. You took advantage of him as he was not able to give consent.

Trouble is, his solicitor will argue that you chose to meet him and his friend and you said yes to the game and you were not dragged to the toilet and you did not scream when he was doing it and you remained there and later had sex with him.

I think a court will find it hard to believe that you said no in the toilet yet did not complain to your friend or ask to leave or call the cops, instead you remained with him and consented to sex. He will say you did not say "I cant" or any other NO.

It would also seen strange that you were drunk when this happened in the toilet yet you choose to remained with him for many hours until you were sober and able to give consent so you did and had sex with him.

Yes report it but don't be surprised if ti fall on its face. You never know maybe he will slip up and admit you at first said no. I would not count on this as clearly these two guys are on the ball.

had you said No it would have been rape
but in this case its just a case of you not being assertive enough.
