How can I have the court bring my daughter back to me?
What she doing is custody interfernce and trying to do a revenge thing because I dont wanna be woth her. I told her my main focus is my daughter I try to work things out with her but she isnt a serious person. I understand if I was a guy that didnt wanna know nothing about my child but I wasn't raised like that im trying to make sure she grows up with a dad but this girl is totally irresponsible and wanna play keep away like of my daughter a toy that just cruel and unhealthy for my daughter. But ne way I had my mother served my babymother with court paper for sole custody of my daughter. She left to portland a week after that to live there even after she was told not to leave. I dont where she satying becsuse she havent been answering and it been 3months that I havent heard how my daighter doing even when i text her or write to her on facebook. I went to my first court appearance and they told me find where she is staying which i dont know because she like jumping from place to place the only info I have from her is her social n my daughter s social. My next appearance is jan 23 2013 my questions is if I dont have a proper address where she living; how can I have the court order her to comeback to new york?

You need a lawyer. In custody cases, it is very rare that they will choose the Father over the Mother. In order for a man to sucessfully win custody he must demonstrate to the court that he has a better job and is better off financially, is free of mental issues or addictive behavior, i.e. drug and alcohol use etc. In addition you cannot have any record of any domestic violence, spousal abuse, incarceration, etc. It must be clearly evident that the children would have a better environment in which to thrive and be healthy. It is a very thorough process of evaluation that takes a very long time and involves not only the courgs but social workers and child protective services. An attorney will walk you through the process and be your advocate.

Get a lawyer. I know your stressing out right now BUT you need to also think of it this way. More this mother ignores the court (keep jumping from a place to place, making you worry), it'll look better on your part. It shows that you care and she doesn't. Most of the times court favors mothers but things like this can risk her from getting custody.

GET A LAWYER!

I'm not sure i understand you, but here's what it looks to me.

You filed for sole custody, meaning your taking the child away from the mother.

Now your complaining that the mother is taking the child away from you.

I assume when you say "she was told not to leave" that she was told by you not to leave. (If she was told by a judge that she couldn't leave, then you could have filed a contempt motion and a judge could have ordered the child returned to you.

My guess is that the judge doesn't necessarily believe that your mother served your ex with the legal paperwork. It sounds as though the judge isn't convinced that she was properly served.

You might consider asking the court to give you permission to serve via Facebook and by publication. This means you would take out a newspaper ad in a Portland newspaper and you would also send her a message on Facebook that tells her about the court action. If you have her mother's name and address, you could also ask for permission to serve her by mailing the documents to her mother's house.
